Original consultation

This consultation seeks views on the proposal to amend the following provisions.

Consultation description

We are considering amending by order the provisions contained in the following Acts:

  • Paragraph 6 of Schedule 28 to the Local Government Planning and Land Act 1980
  • Section 19 of the New Towns Act 1981
  • Paragraph 5 of Schedule 10 to the Housing Act 1988
  • Section 237 of the Town and Country Planning Act 1990.

We plan to make an order under section 203 of the Planning Act 2008.

This will allow restrictive covenants or other rights on land which has been acquired or appropriated by a public authority to be overridden for the use of the land. For example on a permanent basis and not just for the carrying out of works on that land.
