December 2023 update on procurement legislation.
Welsh Government consultation
The Welsh Government recently published its response to the public consultation on the Secondary Legislation associated with the Procurement Act. The response summaries can be found here:

The consultation garnered significant interest from stakeholders, with responses from both the public and private sectors in Wales, including:
- Welsh Local Government Association
- Higher Education sector
- Social Housing sector
- Fire and Rescue Service
- Government bodies including Welsh Government Sponsored Bodies
- Academia
Stakeholders responded favourably to the consultation, and the responses and matters raised will inform the development of our secondary legislation. We will continue to work closely with UK government to ensure alignment of the procurement legislation whilst allowing for devolved differences where appropriate.
Health Service Procurement (Wales) Bill
As part of proposals under the Health Service Procurement (Wales) Bill, the Welsh Government has published a consultation on proposed changes to the way that health services, provided as part of the NHS, are procured in Wales.
Subject to the Bill achieving Royal Assent, the future regulations and accompanying statutory guidance will set out the operational details of the proposed new health service procurement regime in Wales.
The consultation is an important opportunity for stakeholders to comment on the operational principles of the proposed regime; and whether it should align with, or diverge from, proposals detailed in the UK government’s Department of Health and Social Care’s Provider Selection Regime.
