ATISN 16159 – Medical Negligence

Thank you for your request to the Welsh Government for information under the Freedom of Information Act (2000) received on 13 March 2022 regarding medical negligence.  You have requested the following:

  1. The total amount of Welsh Government funding has been used to settle Medical Negligence cases, compensation associated with any Health establishment.

To categorise the listing for each Health Board, plus any direct centralised payments Welsh Government have made a few against the following headings:

  • Clinical Negligence
  • Personal Injury
  • Compensation for the loss of personal items Ex Gratia payments as a result of the Ombudsman making a judgement

The information for the following periods.

2019/20
2020/21
2021/22 (any known figures pre before end of the financial year)

  1. What is the estimate against any of these headings for cases that are open but may not result in a settlement until 2023/24 or beyond

Our response

I have attached a spreadsheet at Annex A detailing the charges related to Clinical Negligence and Personal Injury cases respectively, these costs being drawn from the published annual accounts of NHS organisations. The details for the financial years 2019/20 and 2020/21 are available, the costs for 2021/22 will not be available until the publication of the audited accounts for that year.

Costs for compensation related to judgements by the Ombudsman are not separately captured therefore we do not hold this information.

Cases which are currently open but may not result in a settlement until 2023/24 and beyond are not recorded in the annual accounts, therefore we do not hold that information.
