Terms and conditions for find an apprenticeship and manage apprenticeships.

1. Introduction

1.1 The terms and conditions detailed in this document govern your access to and use of the Apprentice Vacancy Service. The Apprenticeship Vacancy Service will be referred to in this document as the 'service'. 

2. Service operator

2.1 The service is operated by the Further Education and Apprenticeship Division of the Welsh Government, whose principal offices are at Crown Buildings, Cathays Park, Cardiff CF10 3NQ (the 'FEAD').

2.2 If you have any questions about the service, please contact Welsh Government.

3. Use of the service and acceptance of these terms and conditions

3.1 FEAD gives you permission to use the service on and subject to the terms and conditions detailed in (and where appropriate, referred to in) this document.

3.2 By using the service you confirm that you agree to these terms and conditions and that you agree to comply with them. If you do not agree to these terms and conditions you must not use the service. We may amend these terms and conditions from time to time. Your continued use of the service indicates that you accept those changes.

3.3  You are also responsible for ensuring that all persons who access the service through your internet connection are aware of these terms and conditions, and that they comply with them.

3.4 FEAD does not guarantee that the service, or any part of it, will always be available or be uninterrupted. FEAD may suspend or withdraw or restrict the availability of all or any part of the service for business and operational reasons. FEAD will try to give you reasonable notice of any suspension or withdrawal.

3.5 FEAD may withdraw its permission for you to use the service at any time without notice.

4. Materials on the service

4.1 The FEAD is the owner or licensee of all intellectual property rights comprised within the service and materials used as part of the service. This includes, but is not limited to, the design, layout, look, appearance and graphics forming part of the service. Those works are protected by protected by copyright laws and treaties around the world. All such rights are reserved.

4.2 You may look at, use, download and store the material on the service only for personal and research use. You may not use the material for commercial or business use. You may not re-distribute the material or re-publish the material, or give or make available the material to any other person or organisation. You must not modify the digital copies of any materials you have downloaded in any way, and you must not use any illustrations, photographs or any graphics separately from any accompanying text. 

4.3  FEAD’s status (and that of any identified contributors) as the authors of the content of the service must always be acknowledged.

4.4 If you copy or download any part of the service in breach of these terms and conditions, your right to use the service will cease immediately and you must, at our option, return or destroy any copies of any materials you have made.

4.5 Use of the service in a way which does not comply with the terms and conditions detailed in this document, may lead to a claim for compensation for loss or injury and/or be a criminal offence.

5. Accuracy of information

5.1 The information comprised within the service is given in good faith and is provided for general information and interest only. It may change without notice. Although we make reasonable efforts to update the content of the service, FEAD makes no representations, warranties or guarantees, whether express or implied, that the content of the service is accurate, complete or up to date. FEAD is not responsible for any inaccuracies in the information or in the service. Except as detailed in clause 7.3 below, FEAD gives no guarantee that the information in the service is accurate or correct.

5.2 The information comprised within the service is not intended to amount to advice or a recommendation on which you should rely. You must obtain professional or specialist information before taking, or refraining from, any action of the basis of the content of the service. By using the service you agree that you have not relied on the information in the service. Any arrangements made between you and anyone or any organisation named or referred to as part of the service are entirely at your own risk.

5.3 Nothing on the service is intended to be an offer to enter into a contract.

6. Linking and virus protection

6.1 The service contains links to other websites and resources provided by third parties, these links are provided for your information only. FEAD accepts no responsibility or liability for the content of any third party websites. Any link contained in the service is not intended to be an endorsement of any kind by FEAD of those websites or any information you may obtain from them.

6.2 You may not create a link to the service from another website or document unless FEAD has given its prior written permission for you to do this.

6.3 FEAD does not guarantee that the service will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the service. You should use your own virus protection software. You must not misuse the service by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the service, the server on which the service is stored or any server, computer or database connected to the service.

7. Liability

7.1 FEAD does not guarantee that use of the service will work with all hardware and software which may be used by visitors to the service.

7.2 Except as detailed in clause 7.3, FEAD will not be responsible to you in any circumstances whatsoever (whether in contract, tort (including negligence), breach of statutory duty or otherwise) for any direct, indirect or consequential loss including, but not limited to,  economic loss, loss of profits, sales or revenue (whether direct loss or indirect loss), loss of business opportunity, goodwill or reputation and any similar loss however caused in connection with the use of (or inability to use) the service or the use of or reliance on any information or other materials comprised within the service.

7.3 FEAD does not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by FEAD's negligence and for fraud or fraudulent misrepresentation.

8. Monitoring

8.1 FEAD will monitor use of the service, including information inputted by registered users of the Find an Apprenticeship service. Permission is only given for information relating to personal development and career development to be inputted onto the service by registered users. Any information you upload to the service will be considered non-confidential and non-proprietary. You retain all of your ownership rights in the information you provide, but you are required to grant us (and other users of the service) a limited licence to use, store and copy that content and, where appropriate, to distribute and make it available to third parties for use in relation to the service. You warrant that any and all information you upload onto the service will be accurate, complete and up to date. You will be liable to and indemnify FEAD for any breach of that warranty. This means you will be responsible for any loss or damage FEAD may suffer as a result of your breach of warranty. FEAD may at any time remove from the service any information which, in its sole opinion, it considers to be inappropriate and/or in breach of these terms and conditions.

8.2 Despite FEAD’s right to monitor and remove information from the service as detailed in clause 8.1, FEAD is not responsible for any materials produced by registered users of the service and shall have no liability in relation to the content of such materials. Materials produced by registered users of the service are the sole responsibility of the registered user who produced such materials.

9. Privacy

9.1  As part of your use of the service you may provide certain personal information to the FEAD. The privacy notice explains how the FEAD collects, uses, shares and transfers your personal data when you use the service.        

9.2  FEAD is part of the Welsh Government. The Welsh Government's general privacy policy also forms part of these terms and conditions.

10. Cookies

FEAD uses cookies to store information about how you use the service. These cookies are not used to identify you personally. The service cookie policy forms part of these terms and conditions. By using the service you are accepting this cookie policy and agreeing to our use of cookies.

11. Complete agreement

These terms and conditions and the privacy policy referred to in clause 9 contain all the terms and conditions which you and FEAD have agreed in relation to the use and access of the service.

12. Law and jurisdiction

The service is controlled and operated by Further Education and Apprenticeship Division of the Welsh Government from Wales. These terms and conditions and any dispute in relation to the service shall be governed by the laws of England and Wales as applied in Wales. Any disputes which may arise in connection with these terms and conditions or your use of the service will be settled by the English and Welsh courts which will have exclusive jurisdiction.
