Section 259 of the Apprenticeships, Skills, Children and Learning Act 2009 (“the 2009 Act”) introduced new powers for the Privy Council to grant foundation degree awarding powers to further education institutions in Wales by amending section 76 of the Further and Higher Education Act 1992. This provision came into force on 1 October 2010. Section 259 of the 2009 Act also places a duty on the Welsh Ministers to lay before the National Assembly for Wales a report about its effect within four years of commencement.

I am therefore laying a report before the Assembly in pursuance of the duty set out in section 259(2) of the 2009 Act.
