The Planning (Hazardous Substances) (Wales) (Amendment) Regulations 2010 (‘the 2010 Regulations’) came into force on the 19 March 2010. The changes made by the 2010 Regulations bring the hazardous substances consent regime into line with European Directive 96/82/EC, commonly known as the ‘Seveso 2 Directive’.

European Directive 96/82/EC was amended by Directive 2003/105/EC.  Therefore the 2010 Regulations have had to alter the hazardous substances which need consent before they can be stored.  The Regulations contain an exemption until 19 August 2010 to allow time for hazardous substances consents to be obtained.  These consents may be obtained from the relevant Local Authority for the area concerned.
