From 1st October 2015 it will be an offence to sell electronic cigarettes (‘e-cigarettes’) to anyone under the age of 18.

It will also an offence to buy tobacco products or e-cigarettes on behalf of someone  under the age of 18.  This applies to Wales and England.  

The new law means:

  • anyone under the age of 18 will no longer be able to buy e-cigarettes
  • retailers selling e-cigarettes to anyone under  the age of 18 will be committing an offence
  • adults buying e-cigarettes for anyone under the age of18 will be committing an offence.  This is commonly known as ‘proxy purchase’.  It is already an offence in Wales to proxy purchase tobacco products
  • it will not be an offence to sell or proxy purchase an e-cigarette licensed as a medicine for use by anyone under the age of 18
  • Local authorities will enforce the regulations.

The Welsh Government has met with a range of stakeholders with an interest in electronic cigarettes.
