Local authority (LA) staff, headteachers, authorised school staff and the police can issue penalty notices to parents/carers if a child or young person fails to attend school on a regular basis.

This guidance provides advice and sets out responsibilities for LAs, schools and police. It supports the introduction of the Education (Penalty Notices) (Wales) Regulations (external link) which came into force on 2 September 2013.

In summary:

  • LAs were required to consult on and implement a local code of conduct for the use of penalty notices
  • once a code of conduct is in place schools are required to update their appropriate attendance policies.
