Introduction
1. I am directed by the Welsh Ministers to draw your attention to the publication of an Investigation Procedure Statement on gov.wales
2. The purpose of this Circular is to draw attention to the document and explain its purpose.
Scope of this Circular Letter
3. This Circular letter applies to the building control profession in Wales.
Investigation Procedure Statement
4. Under section 58Z3(2) of the Building Act 1984 “The regulatory authority must prepare and publish a statement of the procedure it will follow when investigating an authority or approver under this section (which must include an opportunity for the authority or approver to make representations).”
5. The statement has been prepared and published on gov.wales and outlines the process that we will undertake when we become aware of a situation that may represent a potential contravention of the Operational Standards Rules by a local authority.
6. In the case of an investigation into an RBCA, we have designated this function to the Building Safety Regulator (BSR) and they have published a statement on gov.uk.
