We are updating the guidance on Section 101A of the Water Industry Act 1991. Give us your views.
Consultation description
When assessing if there is whether a duty under section 101A exists and the question of whether it is appropriate to provide a public sewer needs to be provided consideration must be given to any guidance issued by the Welsh Ministers.
Most properties in England and Wales are connected to public sewers. But an estimated 4% of properties are connected to independent privately owned and operated systems.
If these systems are unable to provide a satisfactory long term solution owners can apply for the provision of a public sewer under section 101A.
This draft guidance:
- outlines the options for securing a sustainable sewerage system for properties not connected to public sewers
- provides information to assist householders occupiers and property owners in deciding if section 101A provides the right solution for them
- sets out the roles and responsibilities of the sewerage undertakers the environmental regulators (Environment Agency and Natural Resources Wales) and property owners on how section 101A should be applied
- advises on good practice.
This draft guidance replaces and updates the previous guidance issued by the Department of the Environment and the Welsh Office in 1996.
