The Flood and Water Management Act 2010 received Royal Assent on the 8 April 2010. The Act covers flooding, coastal erosion and water risk management. The Act requires the use of Sustainable Drainage Systems (SUDS) for surface water drainage in all new housing and business developments. It is anticipated that the SUDS approval system will be operational from the autumn of 2011.

We are working with the Department for Environment, Food and Rural Affairs (DEFRA) to produce draft secondary regulations and the National Standards for the design and construction of SUDS. We expect that these will be published for consultation in autumn 2010.

We will provide regional training events after the publication of the draft regulations and standards. These will provide practical guidance on how the requirements set out in the Act, regulations and standards can be integrated with the planning system.
