Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017

On 5 May 2017 The Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017 (“The Regulations”) came into force and apply to:
  • any appeal made in relation to planning and other applications made on or after 5 May 2017,
  • appeals against enforcement notices served on or after 5 May 2017.
The regulations consolidate and revoke the previous regulations relating to planning and associated appeals (see New Regulations – Quick Guide, for further information) and speed up the appeals process. 
 
Appeals against most types of cases dealt with in The Regulations can still be made via the Appeals Casework Portal. 
 
A New Procedure Guide, containing advice on how to complete the appeal form and take part in the appeal process is coming online soon. There are also new appeal forms available. You can however request copies of these by contacting us.

The work of the Planning Inspectorate

The work of the Planning Inspectorate includes:

  • processing planning and enforcement appeals,
  • holding examinations into local development plans.  

The Inspectorate also deals with a wide variety of other planning related casework including:

  • listed building consent appeals,
  • advertisement appeals,
  • reporting on planning applications called in for decision by the Welsh Government.
  • various compulsory purchase orders,
  • rights of way cases
  • cases arising from the Environmental Protection and Water Acts and the Transport and Works Act and other Highways Legislation.

In addition, the Inspectorate processes applications for awards of costs which may arise from any of these.
