Commons Act 2006 - Section 16: Deregistration and Exchange of common land or town and village greens

Section 16 is concerned with the deregistration and exchange of common land and town or village greens.

The owner of any land registered as common land or town or village green may apply to the appropriate national authority for the land to cease to be registered. Where the land put forward for deregistration is more than 200 metres in area the applicant must identify suitable land to register as replacement common land.

Welsh Ministers has appointed The Planning Inspectorate to undertake all the processing of section 16 applications on their behalf up to providing a recommendation on whether or not an application should be approved. The final decision on applications will be taken by Welsh Government officials.
