Fixed Penalty Notices

The use of Fixed Penalty Notices (FPNs) is one of a range of enforcement measures available to Local Authorities to help tackle low level environmental crime.

An FPN can be issued for environmental offences such as:

  • Dropping litter - which includes discarded paper, plastic items, materials associated with smoking, eating, drinking and chewing gum
  • Dog fouling
  • Graffiti and Fly-posting
  • Nuisance parking
  • Abandoned vehicles
  • Unauthorised distribution of literature on designated land
  • Failing to provide a waste carrier licence
  • Failure to provide a waste transfer note
  • Failure to nominate a key holder or give the council key holder details in an alarm notification area
  • Noise from dwellings and licensed premises

Local Authorities in Wales have the power to set the amount charged for an FPN. The Environmental Offences (Fixed Penalties) (Miscellaneous Provisions) (Wales) Regulations 2007 enables Local Authorities to set the amount of a FPN which can range from £75 to £150.  If an authority does not make use of this power, a standard default amount (of either £75 of £100) applies.

The level of an FPN issued for a noise offence is also set by the Local Authority and is determined by the type of offence.
