Proposed procedural changes for advertising road traffic regulation orders
It is proposed, subject to the outcome of this consultation, to amend 3 sets of existing regulations to simplify the process for advertising Traffic Regulation Orders (TROs), giving both Welsh Ministers and Welsh Local Traffic Authorities (WLTAs) greater flexibility for advertising such orders and removing the current statutory requirement to have to place public notices in newspapers.
The Road Traffic Regulation Act 1984 (RTRA 1984) empowers both WLTAs and Welsh Ministers to make Traffic Regulation Orders (TROs) which provide the legal powers to prohibit or restrict traffic for various traffic control purposes. Welsh Ministers are responsible for TROs relating to Trunk Roads and Motorways while WLTAs are responsible for local roads.
These TROs fall into two main categories, namely Permanent Orders (PO) and Temporary Orders (TOs).
These proposals relate to the three current sets of regulations listed below which set out the procedures for the making of TROs in England and Wales.
Road Traffic (Temporary Restrictions) Procedure Regulations 1992 (SI 1992/1215)
These apply to most types of TOs needed on trunk roads and local roads and the procedures apply to both Welsh Ministers and WLTAs.
The Secretary of State’s Traffic Orders (Procedure) (England and Wales) Regulations 1990 (SI 1990/1656)
These apply to permanent (including experimental) TROs needed on trunk roads and outline the procedures for Welsh Ministers must follow.
Local Authorities' Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489)
These apply to permanent (including experimental) TROs needed on local roads and outline the procedures WLTAs must follow.
